The Citizens United Decision and How to Fix It

 

 
 

The Supreme Court upended our political system with its decision in Citizens United v. FEC. The decision, in which the Court ruled that Congress was prohibited from limiting the influence of corporations in elections for public office, represents an unprecedented attack on the core democratic values of the Constitution, and all of us, progressive, centrist and conservative alike, should be deeply concerned about its implications.

Government By the People Campaign Builds Momentum

In 1816, Thomas Jefferson wrote in a letter, "I hope we shall... crush in its birth the aristocracy of our moneyed corporations, which dare already to challenge our government to a trial of strength and to bid defiance to the laws of our country."

The Founders didn't anticipate the threat of corporations to our democracy when the Constitution was ratified, nearly three decades before Jefferson penned those prescient words. But they did give us the tool we need to address then-unforeseen challenges like the Roberts Court's overreaching decision in Citizens United v. FEC: the ability to amend our Constitution.

The Court, by a one vote margin, kicked open the door for unlimited corporate money in our elections with its radical reinterpretation of the First Amendment. While there's some good legislation out there that would mitigate the damage, the only way to undo the harm of Court's ruling completely is with a constitutional amendment. And support for an amendment is growing.

More individuals, organizations and officials are signing on to the effort every day. Senator John Kerry called for a constitutional amendment earlier this month and just this past week, Senators Chris Dodd and Tom Udall introduced a bill in the Senate to do just that.

Also this month, People For released a poll that clearly shows Americans want limits on corporate cash in elections and would support a constitutional amendment.

What's remarkable is that, unlike past attempts to block votes on executive branch nominees, the vote was entirely along party lines. of isolating itself from tough decisions and difficult situations. But our country didn't become a superpower by taking the easy road. I recently returned from an intense and productive trip to
Afghanistan, Pakistan, Kuwait, India and NATO headquarters. Many
others who take this trip have stayed in the U.S. embassies and
capital cities. But what would I learn if I stayed in the embassies? That's why during my trip last week, I got off the beaten path, going
into northern Afghanistan to meet with local leaders and heading out
to Lahore, Pakistan, to meet with local Pakistanis there. These meetings gave me different perspectives on America's role in the
region and our path to success in the war on terror. It also was
helpful in giving me additional insight on making sure we protect our
troops and save taxpayer dollars on wasteful contracting. Best of all, amid all of the meetings, I got to visit with our heroic
men and women in uniform serving our nation in harm's way. I spoke
with troops to thank them for their service and
sacrifice and to make sure they have what they need to be safe and

* The threat of terrorism is real and, in large part, it originated in
the region I visited. America's goal in Afghanistan is to eliminate
terrorists, the Taliban, which has supported them, and any ability for
terrorists to organize attacks against the United States. I wanted to see first hand if we are making progress in defeating the
forces of evil who want to harm our American way of life. We are
making progress but much work remains to be done. I'll continue

Petition to end the filibuster

addressing my Senators, urging them to revisit the outdated
filibuster rule, which effectively requires a supermajority to
pass virtually any legislation in Washington these days.

The history of the middle finger

I never knew this before, and now that I know it, I feel compelled to send it on to my more intelligent friends in the hope that they, too, will feel edified.  Isn't history more fun when you know something about it?  

Before the Battle of Agincourt in 1415, the French, anticipating victory over the English, proposed to cut off the middle finger of all captured English soldiers. Without the middle finger it would be impossible to draw the renowned English longbow and therefore they would be incapable of fighting in the future. This famous English longbow was made of the native English Yew tree, and the act of drawing the longbow was known as 'plucking the yew' (or 'pluck yew').

Much to the bewilderment of the French, the English won a major upset and began mocking the French by waving their middle fingers at the defeated French, saying, See, we can still pluck yew!  Since 'pluck yew' is rather difficult to say, the difficult consonant cluster at the beginning has gradually changed to a labiodentals fricative F', and thus the words often used in conjunction with the one-finger-salute!  It is also because of the pheasant feathers on the arrows used with the longbow that the symbolic gesture is known as 'giving the bird.'

IT IS STILL AN APPROPRIATE SALUTE TO THE FRENCH TODAY!

And yew thought yew knew every plucking thing

Amending the Constitution is not something I take lightly. But the need to do it has been forced on us by Supreme Court's conservative majority. The Roberts Court's recent decision in Citizens United v. FEC said that corporations could spend unlimited money to influence elections. The decision is a departure from a century of legal precedent and offers a radical new interpretation of the First Amendment and how it pertains to corporations. Some of my fellow senators have offered bills to close some loopholes and afford what protections can be allowed in this new legal framework, but a constitutional amendment remains the only real comprehensive fix.

The scholars, advocates and organizations who have called for a constitutional amendment understand, as I do, that this process will be long and hard. But with a strong grassroots movement behind it, it's an effort that can succeed. That's where you come in.

You're already a leader in this movement. Now, please help get at least five others to sign PFAW's petition. I will use it in lobbying my colleagues and advancing this effort.

Corporations ought to be subject to rules that protect average voters and our democratic system as a whole. But the Supreme Court ruled 5-4 that corporation's "right" effectively to buy elections is more important. The Court opened the floodgates for corporate cash in elections but we can close them. They built 13 stories on grade, with no basement, and tied it all down

Here's the story

 

In the weekend's bizarrest news, a nearly finished, newly constructed building in Shanghai toppled over, killing one worker. As can be seen in the photo below, the 13-story apartment building collapsed with just enough room to escape what would have been a far more destructive domino effect involving other structures in the 11-building complex. 

The development, known as "Lotus Riverside," has a total of 629 units, 489 of which have already been sold. Now buyers are clamoring to get their money

 moneyback, and authorities are making efforts to reassure them. The assets of the project's developer, Shanghai Meidu Property Development Co., have been frozen and the city officials said the developer's ability to repay homebuyers was secure, according to a statement on the municipal government's Web site (in Chinese). A hotline has been set up for Lotus Riverside buyers, and by Sunday afternoon, more than half of them had met with a group of lawyers and officials organized to help them negotiate with the developer, according to the statement.

Meanwhile, the cause of the accident is under investigation and nine unidentified people from the developer, contractor and management company have been DETAINED!.

A representative of Shanghai Meidu could not be reached for comment.

The disaster could reveal some uncomfortable facts about lax construction practices in China , where buildings are put up in a hurry by largely unskilled migrant workers, and developers may be tempted to take shortcuts.

According to Shanghai Daily, initial investigations attribute the accident to the excavations for the construction of a garage under the collapsed building. Large quantities of earth were removed and dumped in a landfill next to a nearby creek; the weight of the earth caused the river bank to collapse, which, in turn, allowed water to seep into the ground, creating a muddy foundation for the building that toppled.

The South China Morning Post noted that the pilings used in the Lotus Riverside development, made of prestressed, precast concrete piles, are outlawed in Hong Kong because they aren't strong enough to support the kind of ultra-high buildings that are common in Hong Kong . But in mainland China , they are often used because buildings there are typically much shorter (subscription required).

Quality problems have long plagued construction in China , though they seem to be more apparent in rural areas and smaller cities, not in major metropolises such as Shanghai and Beijing . When school buildings were flattened by last year's massive Sichuan earthquake, a number of parents faulted shoddy construction for creating "tofu buildings" that fell while other nearby structures were able to withstand the impact of the quake. More recently, state media reported that several new dams along the Yellow River are in danger of collapse, a situation attributed to shoddy construction practices, embezzlement and unqualified workers.

It turns out that nobody likes the idea of corporations spending billions of dollars on political campaigns. According to recent polling, overwhelming majorities of Democratic, Republican, and Independent voters oppose the Supreme Court's ruling in Citizens United, and most favor passing new limits on corporate political spending.

Check out this data from a Washington Post-ABC News poll earlier this month:

According to this poll, it also doesn't matter if you are young or old, rich or poor, black or white, a man or a woman -- big majorities oppose the Supreme Court on this and want Congress to show some backbone and rein in this corporate giveaway. I think our bill is a good start -- I want to make sure corporations:

  1. FULLY DISCLOSE when they spend from their treasuries to protect special interest cronies in Washington
  2. REQUIRE CONSENT from shareholders in the form of a majority vote before they advocate for or against candidates
  3. PROTECT OUR ELECTIONS from the influence of foreign-owned corporations spending freely on American politics

President Obama has released a new health reform proposal -- and our political director just sent me an overview that I wanted to share with you.

Here's the bottom line: It's a plan that puts Americans in charge of their own health care, bridges the gap between the Senate and House bills, and adds additional ideas from both parties to fight waste and abuse.

The plan will serve as a starting point for discussion at a major bipartisan meeting this Thursday between the President and congressional leaders to discuss Republican and Democratic ideas for improving our health care system. And if there are more areas of agreement, they'll be added to the plan.

Ultimately, we're going to move forward with a bill that lowers costs, increases competition, provides relief for families and small businesses, and covers the uninsured -- and we'll need your help to do it.

Please take a look at the details of the proposal so that you'll have all the info you'll need for the fight ahead, and send them on to anyone else you know who is fighting for reform.

FYI, here's a quick overview from the White House of the President's just-released proposal on health reform. Exciting stuff.

It builds on legislation passed by the House and Senate, bridging the differences in those bills while adding new provisions.

The most notable addition is the creation of a new "Health Insurance Rate Authority," which would give the federal government the power to review unreasonable rate increases and other unfair practices by the big insurance companies.

The policy experts I speak to think this is a really strong improvement -- and would help a lot of people in places where insurers are jacking up rates like they are in California, Maine, and around the country.

Overview of the President's Proposal

The President's Proposal puts American families and small business owners in control of their own health care.

-- It makes insurance more affordable by providing the largest middle class tax cut for health care in history, reducing premium costs for tens of millions of families and small business owners who are priced out of coverage today. This helps over 31 million Americans afford health care who do not get it today -- and makes coverage more affordable for many more.

-- It sets up a new competitive health insurance market giving tens of millions of Americans the exact same insurance choices that members of Congress will have.

-- It brings greater accountability to health care by laying out commonsense rules of the road to keep premiums down and prevent insurance industry abuses and denial of care.

-- It will end discrimination against Americans with pre-existing conditions.

-- It puts our budget and economy on a more stable path by reducing the deficit by $100 billion over the next ten years -- and about $1 trillion over the second decade -- by cutting government overspending and reining in waste, fraud and abuse.

It includes a targeted set of changes to the Patient Protection and Affordable Care Act, the Senate-passed health insurance reform bill. Key changes include:

-- Closing the Medicare prescription drug "donut hole" coverage gap;

-- Strengthening the Senate bill's provisions that make insurance affordable for individuals and families;

-- Strengthening the provisions to fight fraud, waste, and abuse in Medicare and Medicaid;

-- Increasing the threshold for the excise tax on the most expensive health plans from $23,000 for a family plan to $27,500 and starting it in 2018 for all plans;

-- Improving insurance protections for consumers and creating a new Health Insurance Rate Authority to provide federal assistance and oversight to states in conducting reviews of unreasonable rate increases and other unfair practices of insurance plans.
